Terms and Conditions
for the provision of services by Kollekto GmbH, Ostdorf 15, 59069 Hamm, Email: admin@kollekto.de (hereinafter "Contractor") to its customers (hereinafter "Client")
1. General
1.1 These General Terms and Conditions (T&C) for the provision of services apply to contracts concluded between the Client and the Contractor with the inclusion of these T&C.
1.2 Insofar as other contractual documents or other terms and conditions in text or written form have become part of the contract in addition to these T&C, the provisions of these additional contractual documents shall take precedence over these T&C in the event of a conflict.
1.3 T&C used by the Client that deviate from these terms and conditions are not recognized by the Contractor โ subject to express consent.
2. Subject Matter and Scope of Services
2.1 The Contractor provides the following services to the Client as an independent entrepreneur:
Kollekto.de is an online platform operated by Kollekto GmbH that enables users to digitally manage, present, and share their private or commercial collections.
The platform offers the following functions and services, among others:
- Management and cataloging of collection items (e.g., video games, trading cards, figures, etc.);
- Display and analysis of market and price data;
- Gamification elements (e.g., experience points, levels, quests, leaderboards);
- Social interactions such as likes, comments, and follower functions;
- A marketplace for buying and selling collection items between users;
- For commercial providers: the ability to operate an online shop via their own subdomain (e.g., sample-shop.kollekto.de) and offer goods directly via the platform;
- Optional: Use of merchant tools, price automation, cash register system integration, and ERP functions for buying and selling stores.
Kollekto.de only provides the technical platform and โ unless expressly stated otherwise โ does not become a contractual party itself in purchases or sales between users.
2.2 The specific scope of services is the subject of individual agreements between the Contractor and the Client.
3. Cooperation Obligations of the Client
It is the responsibility of the Client to provide complete and correct information, data, and other content that they must make available for the purpose of service fulfillment.
4. Remuneration
4.1 The remuneration is agreed upon individually.
4.2 The remuneration is to be paid after the services have been rendered.
4.3 The Contractor issues an invoice to the Client after providing the services by mail or email (e.g., as PDF). Payment is due within 14 days of receipt of the invoice.
5. Liability / Indemnification
5.1 The Contractor is liable without limitation for any legal reason in case of intent or gross negligence, in case of intentional or negligent injury to life, body, or health.
5.2 The Client indemnifies the Contractor against any claims by third parties that are asserted against the Contractor due to violations by the customer of these contractual conditions or applicable law.
6. Contract Duration and Termination
6.1 The contract duration and the deadlines for ordinary termination are agreed upon individually by the parties.
6.2 The right of both parties to extraordinary termination for good cause remains unaffected.
7. Confidentiality and Data Protection
7.1 The Contractor will treat all matters that come to their knowledge in connection with the contract strictly confidentially.
7.2 The Contractor undertakes to comply with all data protection regulations when carrying out the contract.
8. Final Provisions
8.1 The law of the Federal Republic of Germany applies, excluding the CISG.
8.2 Should a provision of these T&C be or become invalid, the validity of the remaining T&C shall not be affected.
